Smiffys successful in copyright judgment

A judgement was made against I Love Fancy Dress for copyright infringement.

Fancy dress, costume and party product licensee Smiffys has been successful in gaining a judgment of the Royal Courts of Justice, Intellectual Property Enterprise Court, against I Love Fancy Dress for copyright infringement.

The court agreed that I Love Fancy Dress had infringed Smiffys’ copyright by using several of Smiffys’ images across its website, Amazon and eBay stores.

I Love Fancy Dress was using Smiffys own images to advertise both its own-branded product and the branded product of other fancy-dress manufacturers.

The court ordered that I Love Fancy Dress pay damages and costs to Smiffys in respect of such copyright infringement. It also issued an injunction against I Love Fancy Dress to stop the company from using Smiffys’ copyrighted images in the future.

“Smiffys welcomes the judgement and the positive outcome for our brand. We will continue to vigorously pursue any violations of our copyright and the court ruling spurs us to pursue infringers that seek to misuse our intellectual property”, said Elliott Peckett, director at Smiffys.

Smiffys has a dedicated intellectual property and brand protection team which is committed to protecting both Smiffys’ own business and the business of its customers.

Smiffys will continue to rigorously pursue any company which infringes its intellectual property and will take all necessary steps, including the issuing of court proceedings in the IPEC, to enforce its brand and copyright.
